This website, https://gemsmantra.com ("Website"), is owned and operated by Astro Arun Pandit Private Limited (hereinafter referred to as "Astro Arun Pandit", "GemsMantra", "the Company", "we", "us" or "our"), having its registered office at Plot No. 406, Gali No. 2, Krishna Puri, Chhapeda, Kanpur, Uttar Pradesh – 208025, India. GemsMantra offers its services to you subject to the terms and conditions set out below. If you use, visit, register as a member of, or purchase from the Website, you accept these Terms. If you do not agree to all of these Terms and Conditions, please refrain from using the Website or any of the services offered herein.

1. Acceptance of These Terms

This Agreement is an electronic contract that sets out the legally binding terms of your use of the Website and your membership in the Service. By accessing the Website, becoming a member, and/or purchasing something from us, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms of Service", "Terms" and "Terms and Conditions"), including the additional terms, conditions and policies referenced herein and/or available by hyperlink. 2. Eligibility & Age

The Services are available only to individuals who can form legally binding contracts under the applicable laws of India and the country of their residence. Without limiting the foregoing, the Services are not permitted to be used by minors, or by any GemsMantra member who is temporarily or indefinitely suspended. By using the Website you represent and warrant that you have the right, authority and capacity to enter into this Agreement and to abide by all of its terms and conditions.

3. Your Account & User Obligations

You are responsible for the accuracy of the information you provide to us and for the activity that takes place under your account or membership. Your membership is for your sole, personal use — it may not be assigned, transferred, licensed or used by any other person or entity, and you may not authorise others to use it.

You grant the Company, its affiliates, licensees and successors an irrevocable, perpetual, non-exclusive, fully paid, worldwide licence to use, copy, display, reproduce, adapt, modify and distribute any content you post to public areas of the Website, and to prepare derivative works of it. You represent and warrant that you have the right to grant this licence and that your content will not infringe the rights of any third party. The Company may review, and in its sole judgment remove or delete, any content that violates this Agreement or that may be offensive, illegal, or that may harm the rights or safety of the Company, its affiliates, personnel or members.

4. Products, Pricing & Description Accuracy

The Website, the materials and content contained in it, and the products and services provided in connection with it, are provided on an "AS IS" basis without warranties of any kind, either express or implied, except as expressly provided to the contrary in writing by the Company. The material on this Website is for general information only and should not be relied upon as the sole basis for any decision without consulting primary, more accurate, more complete or more timely sources. Any reliance on the material is at your own risk.

We make every effort to display the colours, sizes and images of our products as accurately as possible; however, the actual colours you see depend on your device and monitor, and we cannot guarantee that your display will accurately reflect the product on delivery. Because our gemstones and rudraksha are natural, each piece has a distinctive colour, texture and origin, and may therefore differ slightly from the displayed image. Packaging may also vary from that shown. Slight natural variation of this kind is a feature of genuine natural products and is not a defect.

Right to correct errors and refuse or cancel orders. Prices on our Website are subject to change without notice, and you will be charged the price listed on the day of purchase. We reserve the right (but are not obligated) to limit the sale of our products or services to any person, geographic region or jurisdiction, to limit quantities, and to discontinue any product at any time. We reserve the right to refuse, correct, cancel or refund any order — including after an order has been placed — where there is an obvious pricing or description error, suspected fraud, stock unavailability, or where delivery to the specified location cannot be fulfilled; in such cases you will be notified and any amount charged for the affected order will be refunded. Prices for orders shipped within India are payable in INR and are inclusive of CGST/SGST/IGST as applicable; a GST tax invoice is issued on every order.

5. Order Acceptance, Cancellation & Modifications

Your order is an offer to buy, which we may accept or decline as set out above. Certain products may be available exclusively online, may have limited quantities, and/or may be made to order or procured on order; these are subject to return or exchange only in accordance with our Refund Policy.

6. Shipping, Delivery & Customs

We deliver across all cities in India and to 150+ countries internationally. Please check whether we deliver to your PIN code at checkout; if no courier service is available in your area, we apologise for the inconvenience and request that you contact support@gemsmantra.com. Delivery to certain locations may not be possible due to country-specific restrictions or logistical issues, and we reserve the right to cancel or modify any order that cannot be fulfilled to the specified location, with a full refund of the affected order.

A tentative delivery date is shared with your order confirmation, and the exact date is confirmed once your order is ready for dispatch. Delivery times are estimates only and are subject to change due to factors beyond our control — including shipment issues, customs delays, weather or other unforeseen circumstances — and we cannot be held responsible for delays caused by third parties or external factors, though we will keep you informed. For international orders, any customs duties or taxes levied by the destination country are payable by the buyer on delivery and are non-refundable. The astrological remedies, consultations and predictions provided by Astro Arun Pandit are grounded in astrological and Vedic principles and are meant to offer guidance and self-reflection. Astrology is inherently interpretive, and results may vary for each individual. The advice given should complement, and not replace, professional counsel in areas such as medical, legal or financial matters.

Astro Arun Pandit does not guarantee any specific outcome, and clients and users are encouraged to make their own informed decisions. Gemstones and rudraksha are offered as items of traditional faith and belief; they are not medicine and make no promise of a cure or a guaranteed result. We do not warrant that the quality of any product, service, information or material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. 8. Disclaimer of Warranties

The Company owns and retains all proprietary rights in the GemsMantra Website and the products and services offered on it. The Website contains copyrighted material, trademarks, brand names, logos and other proprietary information of the Company and its licensors. Except for information that is in the public domain or for which you have been given express written permission, you may not copy, modify, publish, transmit, distribute, perform, display, reproduce or sell any such proprietary information. Any such act, or attempted act, constitutes a violation of this Agreement and may result in immediate termination of your membership without refund.

The GemsMantra Website is for the personal use of individual members and may not be used for any commercial endeavour unless you are registered and approved as an "Affiliate" of GemsMantra. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without our express written permission. Illegal or unauthorised uses of the Website — including unauthorised framing of, or linking to, the Website — will be investigated and appropriate legal action taken, including civil, criminal and injunctive remedies. GemsMantra shall be entitled to recover from you (and your successors, heirs and assigns) any profit, revenue or benefit that you have gained, received or expected to receive through unauthorised use of this Website, together with a penalty at 50% of such profit, revenue or benefit.

While providing services, GemsMantra may outsource any part of them to a competent person or organisation, with or without disclosing this to you; however, your membership rights and responsibilities continue only against GemsMantra and not against such persons or organisations.

We are not liable for any delay in the performance, or for any non-performance, of any of our obligations, and shall not be liable for any loss or damage caused thereby, where the same is occasioned by any cause beyond our reasonable control — including, but not limited to, an act of God, war, civil disturbance, riots, strikes, lock-outs, governmental or parliamentary restrictions, prohibitions or enactments of any kind, pandemic, import or export regulations, exchange-control regulations, accident, or the non-availability of or delay in transport.

15. Term & Termination

This Agreement remains in full force and effect while you use the Website and/or are a member. You may terminate your membership at any time by informing GemsMantra in writing or by ceasing to use the Website. If in our sole judgment you fail (or we reasonably suspect that you have failed) to comply with any term of these Terms of Service, we may terminate this Agreement at any time without notice; you will remain liable for all amounts due up to and including the date of termination, and we may deny you access to our Services. If your membership is terminated for a material breach, you will not be entitled to any refund of unused subscription fees. All decisions regarding termination are made at the sole discretion of GemsMantra, and any provision that by its nature is intended to survive termination — including obligations and liabilities incurred prior to termination — shall survive.

16. Governing Law & Jurisdiction

In the first instance, we request that you raise any concern with our customer support and grievance team at support@gemsmantra.com so that we can attempt to resolve it amicably and promptly. This does not, however, take away or limit any right you may have under applicable consumer-protection law that cannot be waived by agreement.

17. Communications Consent

By registering your contact details with us, you authorise and give consent to the Company — either itself or through any third-party service provider — to send you, from time to time, information, alerts, SMS, other messages, calls and commercial communication and other service-related communications on the telephone number(s) you have provided, whether or not those numbers are registered with the National Do Not Call Registry or listed in the National Customer Preference Register. You confirm that you will not hold the Company or its third-party service provider liable, or institute a complaint under the Telecom Commercial Communications Customer Preference Regulations (TRAI), 2010 or any other applicable regulations, in respect of such communications.
