Gemsmantra.com (hereinafter referred to as “Gemmantra.com” or “the Website” or “the Site” or "we" or "us" or "our") provide its services to you subject to the following terms & conditions. If you use, visit, or register as a member of the website, you accept these conditions. Please read them carefully. The Terms of Use are subject to change by Gemsmantra.com without any prior intimation at any time, effective upon posting on the Gemsmantra.com website, and your use of the Website or the Service after such posting will constitute acceptance of your of such changes. Those who choose to access this Website from outside India are responsible for compliance with local laws to the extent local laws are applicable.

This Website, the materials and content contained therein and the products and services provided or in connection therewith are provided on an "AS IS" basis without warranties of any kind, either express or implied, except as expressly provided to the contrary in a writing by the Company, if any. We have made every effort to display the colours and sizes of our products that appear on our Website as accurately as possible. However, the actual colours you see will depend on your monitor. We cannot guarantee that your monitor's display of any colour will accurately reflect the color of the product on delivery. Packaging of the product may vary from that displayed on the Website.

5. Delivery Location and Timeline

In India, we serve all cities across India. Please check if we deliver to your PIN Code in the shopping cart checkout page. If there is no courier service available in your area, we do apologize for the inconvenience caused. In such a situation we request you to kindly contact our customer support team at support@gemsmantra.com.

We also provide international delivery across the globe. Please be advised that delivery to certain locations may not be possible due to country-specific restrictions or other logistical issues. We reserve the right to cancel or modify any order if delivery to the specified location cannot be fulfilled. In such cases, you will be notified promptly, and a full refund will be issued for the affected order. It is the customer's responsibility to ensure that the delivery address provided is within a region where delivery is supported.

A tentative delivery date/time will be sent along with the order confirmation email. The exact delivery date shall be provided as soon as your order is ready for dispatch.

If the delivery timeline falls on a public holiday or Sunday, the timeline for delivery will be extended by another day. Customers can also track their order by contacting our customer support team as detailed on the Website. Notwithstanding anything above, delivery times are estimates and are subject to change due to various factors beyond our control, including but not limited to shipment issues, customs delays, weather conditions, or other unforeseen circumstances. While we make every effort to fulfill orders within the specified time frame, we cannot be held responsible for delays caused by third parties or external factors. In the event of a delay, we will inform you as soon as possible, but we do not guarantee a specific delivery date.

6. Payment and Modifications to Prices/Services

Prices on our Website are subject to change without notice. Please expect that you will be charged the price for the services as it is listed on the day of purchase. We reserve the right to modify or discontinue the Service (or any part or content, product, tool, etc available on the website thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. For orders being shipped within India, payment only in INR is accepted. Prices are inclusive of CGST/SGST/IGST, as applicable. In case international credit cards are being used for domestic orders, the transaction amount will be converted to INR before the payment is accepted. Currency conversion charges may apply according to your credit/debit card policy. You may be required to share with us a copy of any Government issued photo identity proof of the country of residence.

Payments for International Orders are accepted through Razorpay and /Zoho Secure Payout gateway either by your bank account or by using International credit/debit cards only. We also accept direct bank transfers for such orders. For orders being shipped outside India, the payment will be accepted only in INR currency. Applicable currency conversion rates will apply according to the prevailing exchange rates on the day of placing the order. Prices for international orders will include shipping and handling charges, taxes, etc., pertaining to the country of delivery.

Note - For Orders above value of INR 02 (Two) lakhs, you are required to send us the PAN Card.

7. Bank Account Information

You are obligated to provide accurate banking information as required by the Company for the purpose of processing payments. By using the Services, the User agrees to the following obligations:

Accuracy of Payment Information - You agree that the debit/credit card details provided for the use of the Services must be correct and accurate. You further agree that you will not use any debit/credit card that is not lawfully owned by you, nor any card for which you are not authorized by the lawful owner to use. You undertake to provide only valid and correct debit/credit card details. Payment Methods - You confirm that there are sufficient funds or credit available in the nominated card/bank account to cover the payment, including any applicable fees.

Payment Authorization - You confirm that by providing your payment details and initiating a payment transaction, you authorize the Company to process the transaction, subject to the terms and conditions of this Agreement.

8. Products

Certain products may be available exclusively online through the website. These products or services may have limited quantities and/or are made to order/procured on order in nature; these products are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate. Please note that due to their distinctive color, texture, origin, etc certain products displayed on the website may be slightly different than the displayed image. In the event of any discrepancies or issues related to your order, including but not limited to product/services concern, delivery delays or shipment concerns, our customer support team will provide assistance and make reasonable efforts to resolve the matter. However, please note that while we will assist you to the best of our ability, we cannot be held liable for third-party delays or issues beyond our control.

We reserve the right to limit the quantities of any products or services that we offer. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. The Company will make reasonable efforts to resolve any issues, but no legal action may be pursued as a result of discrepancies or wrong services.

9. Accuracy of billing and account information

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. Before placing an order you shall check the product description carefully. By placing an order for a product/, you agree to be bound by the conditions of sale and invitation to offer included in the item's description.

10. Non-Commercial Use

The Gemsmantra.com Website is for the personal use of individual members, and cannot be used in connection with any commercial endeavors unless registered and approved as an ‘Affiliate’ of Gemsmantra.com. The commercial endeavors include providing links to other websites, whether deemed competitive to Gemsmantra.com or otherwise.

Illegal and/or unauthorized uses of the website, including unauthorized framing of or linking to the Website will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress. Gemsmantra.com shall be entitled to recover from you, your successors, heirs, assigns, etc. any profit, revenue, benefit, etc., which you have gained/ received, expected, or going to receive with a penalty @ 50% of such profit/ revenue/ benefit by unauthorized use of this site.

Your Membership is only for personal use. It is not to be assigned, transferred, or licensed so as to be used by any other person/entity. Members are advised to make appropriate/thorough inquiries before acting upon any service and/or advertisement. Our Website does not vouch for or subscribe to the claims and representations made by advertisers. Kindly note that your membership at Gemsmantra.com is for your sole, personal use. You may not authorize others to use your membership and you may not assign or transfer your account to any other person or entity.

Any breach of the Terms and Conditions mentioned herein by any user shall attract termination and/or suspension of the membership. Please note that the user is solely responsible to strictly adhere to these terms and conditions.

12. Term

This Agreement will remain in full force and effect while you use the Website and/or are a Member. You may terminate your membership and/or subscription at any time by informing Gemsmantra.com in writing to terminate your membership. If you terminate your subscription, you will not be entitled to a refund of any unutilized subscription fees or access to digital content or reports purchased through Gemsmantra.com. Gemsmantra.com may terminate your membership and/or subscription by sending a notice to you at the email address you provide in your application for membership, or such other email address as you may later provide to Gemsmantra.com. If Gemsmantra.com terminates your membership in the Service because of any material breached to this Agreement, you will not be entitled to any refund of unused subscription fees. All decisions regarding the termination of Accounts shall be made at the sole discretion of Gemsmantra.com. Gemsmantra.com is not required to provide you any notice whatsoever prior to terminating your membership and/or subscription. Gemsmantra.com is not required and may be prohibited from disclosing a reason for the termination of your account. All terms that by their nature survive termination of this Agreement shall be deemed to survive such termination irrespective of any termination of membership and/or subscription.

13. Right To Form Consortium/Associates

While providing services, Gemsmantra.com may outsource any part thereof to any competent person or organization, with or without disclosing it to you. However, your membership rights and responsibilities continue as against Gemsmantra.com only and not against such persons or organizations.

14. Proprietary Rights

1. The Company owns and retains all proprietary rights in the Gemsmantra.com website and products/services offered herein. The Website contains the copyrighted material, trademarks, and other proprietary information of the Company, and its licensors. Except for that information that is in the public domain or for which you have been given permission, you cannot copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. Any such act or an attempted act on your part shall constitute a violation of this Agreement and your membership is liable to be terminated forthwith by Gemsmantra.com without refund of any of your unused Subscription fees.
2. Reliance on Content, Advice, Opinions, statements, offers, or other information or content made available through the website, but not directly by us, are those of their respective authors, and should not necessarily be relied upon. Such authors are solely responsible for such content. The Company does not: (i) guarantee the accuracy, completeness, or usefulness of any information on the Service, or (ii) adopt, endorse or accept responsibility for the accuracy or reliability of any opinion, advice, or statement made by any party that appears on the Website. Under no circumstances will the Company or its affiliates be responsible for any loss or damage resulting from your reliance on information or other content posted on the Website or transmitted to or by any Members. 15. Obligations of the User

1. You are solely responsible for the Content that you publish or display (hereinafter, "post") on the Website, to the Company personnel/affiliate, or transmit to other Members. You will not post or transmit to the Company, its affiliates, personnel and/or other Members, any defamatory, inaccurate, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, racially offensive, or illegal material, or any material that infringes or violates another party's rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity). You will not provide inaccurate, misleading, or false information to the Company or to any other Member. If the information provided to the Company, Its affiliates, personnel and/or another Member, subsequently becomes inaccurate, misleading, or false, you will promptly notify the Company of such change. Gemsmantra.com reserves the right to verify the authenticity of Content posted on the Site. In exercising this right, the Company may ask you to provide any documentary or other form of evidence supporting the Content you post on the Site. If you fail to produce such evidence, the Company may, at its sole discretion, terminate your Membership without a refund.
2. You understand and agree that the Company may review and delete any content, messages, photos, or profiles (collectively, "Content"), in each case in whole or in part, that in the sole judgment of the Company violate this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of either the Company, Its affiliates, personnel and/or its Members.

By posting Content to any public area of the Company, you automatically grant, and you represent and warrant that you have the right to grant, to the Company, its affiliates, licensees, and successors, an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, reproduce, adapt, modify and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information, and content, and to grant and authorize sublicenses of the foregoing. You further represent and warrant usage of your content by the Company will not infringe or violate the rights of any third party.

   6. provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under the age of 18;
   7. provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
   8. solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.

The Company reserves the right to investigate and terminate your membership if you have misused the Service/Proprietary information, or behaved in a way that could be regarded as inappropriate or whose conduct is unlawful or illegal. • NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, THE COMPANY’S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO THE COMPANY, FOR THE SERVICE DURING THE TERM OF MEMBERSHIP.

The Company reserves the right at any time to modify or discontinue, temporarily or permanently, the website and the information/product/services offered therein (or any part thereof) with or without notice. 19. Disputes And Applicable Law

If there is any dispute about or involving the Site and/or the Service/products offered herein, by using the Site, you unconditionally agree that all such disputes and/or differences will be governed by the laws of India and shall be subject to the exclusive jurisdiction of the Competent Courts in Delhi, India only. 

20. Indemnity

You agree to indemnify and hold the Company, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above.

21. No Third Party Beneficiaries

Except as expressly provided in this Agreement, the parties hereto agree that this Agreement is intended solely for the benefit of the parties hereto and shall not confer any rights or benefits upon any third party. No third party shall have any rights, claims, or causes of action under this Agreement.

22. Dealing With Advertisers

Any of your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the service, including payment and delivery of related goods or services, and any other terms, conditions, warranties, or representations associated with such dealings, are solely between you and such advertiser. You agree that the Company shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the website.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

This Agreement contains the entire agreement between you and the Company regarding the use of the Website and/or the Service/Product. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. You are under an obligation to report any misuse or abuse of the site. If you notice any abuse or misuse of the site or anything that is in violation of this Agreement, you shall forthwith report such violation to the Company  by writing to Customer Care. On receipt of such a complaint, the Company may investigate such a complaint and if necessary may terminate the membership of the Member responsible for such violation, abuse, or misuse without any refund of the subscription fee. Any false complaint made by a Member shall make such Member liable for termination of his/ her membership without any refund of the subscription fee.

25. Force Majeure

We are not liable for any delay in the performance or non-performance of any of our obligations hereunder and shall not be liable for any loss or damages caused thereby where the same is occasioned by any cause whatsoever that is beyond our control including but not limited to an act of God, war, civil disturbance, riots, strikes, lock-outs, governmental or parliamentary restrictions, prohibitions or enactments of any kind, pandemic, import or export regulations, exchange control regulations or accident or non-availability/ delay in transport.

26. Support Services and Contact Information

I hereby authorize and give consent to the Company to send me, either through itself or through any third party service provider, from time to time various information / alerts/SMS/ Other messages or calls or commercial communication, and other services on the aforesaid listed telephone numbers, whether these numbers are registered with National Do Not Call Registry/Listed in national customer preference register or not. I also confirm that by sending any of such messages/calls, I will not hold ASBL its third party service provider liable/institute complaint under the Telecom Commercial Communications Customer Preference (TRAI) Regulations, 2010 or such other applicable regulations including any amendment thereof, as may be applicable from time to time. It will be auto renewed every month and if you want to stop this service please write an email to support@gemsmantra.com.
